A RESOLUTION authorizing the County Executive to execute an easement agreement for a permanent easement along multiple tracts of land along Woods Chapel Road in favor of Aquila, Inc., for the installation, operation, and maintenance of guy wires and anchors, for a total fee to be paid to the County in the amount of $2,600.00.

WHEREAS, Aquila, Inc., is engaged in the installation, operation, and maintenance of power lines on multiple tracts of land along Woods Chapel Road, and a permanent easement is necessary to install guy wires and anchors to provide safe electrical service to the public; and,
WHEREAS, Aquila, Inc., has requested a permanent easement on property located within the boundaries of Jackson County property under the supervision of Jackson County Parks and Recreation, as more fully described in the attached proposed easement agreement; and,
WHEREAS, for this easement, Aquila, Inc., has agreed to pay a fee of .40 per square feet of permanent easement and the easement processing fee, in a total amount of $2,600.00; and,
WHEREAS, the Director has determined that the permanent easement will have no adverse effect to the park property and recognizes the public necessity of the provision of safe electrical service; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached easement agreement is hereby approved and that the County Executive is hereby authorized to execute the agreement on behalf of the County.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
