Body
WHEREAS, Missouri state law currently requires that all financing of sewer line improvements by the Little Blue Valley Sewer District be approved by the electors within the District; and,

WHEREAS, the District is unique in its stature as a public sewer district because it does not provide services directly to an end user but rather provides its customers the ability to serve citizens and residents of the participating municipalities and counties; and,

WHEREAS, current Missouri law does not provide for the approval of financing techniques through the issuance of bonds or participating in bond fund programs with approval of the customers; and,

WHEREAS, it is appropriate that the customers of the District have an opportunity to make improvements to the District through the issuance of bonds with the approval of such customers; and,

WHEREAS, it is of primary interest to the Legislature to ensure that the District continues to provide sewer services to the County for the health, safety and welfare of the County's citizens; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature hereby expresses its support and encourages the adoption of legislation which would amend Section 204.370 (1), Revised Statutes of Missouri, to read as follows: No common sewer district shall issue or deliver any bonds for the purpose of acquiring, constructing, improving or extending any sewerage system payable from the revenues to be derived from the operation of the system unless a proposition to issue the bonds shall have received the assent of four-sevenths of the voters of the sewer district who shall vote...
