RE: PREFERENCE FOR AMERICAN PRODUCTS (“BUY AMERICAN” POLICY)
Title
Pursuant to section 34.353.3(5), RSMo 2016, I hereby promulgate the following policy to encourage the purchase of products manufactured or produced in the United States;
1. Any manufactured goods or commodities used or supplied in the performance of any county contract or any subcontract thereto shall be manufactured or produced in the United States whenever possible.
2. Each contract for the purchase or lease of manufactured goods or commodities by the county and each contract made by the county for construction, alteration, repair, or maintenance of any public work shall contain a provision that any manufactured goods or commodities used or supplied in the performance of that contract or any subcontract thereto shall be manufactured or produced in the United States whenever possible.
3. When bids offer quality, price, conformity with specifications, terms of delivery and other conditions imposed in the specifications that are equal, the county shall select the bid that uses manufactured goods or commodities that are manufactured or produced in the United States.
4. Nothing in this executive order is intended to contravene any existing treaty, law, agreement, or regulation of the United States. All county contracts under this executive order shall be entered into in accordance with existing treaty, law, agreement, or regulation of the United States including all treaties entered into between foreign countries and the United States regarding export-import restrictions and international trade.
