Body
WHEREAS, there is pending in the Circuit Court of Clay County, Missouri, the case of James Wirken, Conservator ad Litem of the Estate of Helen Morrison v. Christopher Miller, et al.; and,

WHEREAS, in this case, the petitioner has alleged that certain former employees of the Jackson County Public Administrator's office stole significant assets from the estate of Ms. Morrison, a ward of that office; and,

WHEREAS, the petitioner has proposed that this litigation be settled by the County's payment to the petitioner in the amount of $500,000; and,

WHEREAS, the County Counselor recommends the acceptance of this settlement proposal as in the best interests of the health, welfare, and safety of the citizens of Jackson County; and,

WHEREAS, of the total amount of the settlement, approximately $493,000 will be reimbursed to the County by its insurer, ITT-Hartford; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be, and hereby is, authorized to settle the case of Wirken v. Miller, on the terms outlined above; and,

BE IT FURTHER RESOLVED that the Director of the Department of Finance be and hereby is authorized to make all payments required to effect this settlement; and,

BE IT FURTHER RESOLVED that the County Counselor be and hereby is authorized to execute any documents necessary to effect this settlement.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
