Body
WHEREAS, the County Executive has advised the Legislature that the Circuit Court has requested a General Fund budget increase of 4.95%, or $1,523,228.00 for 2009; and,
WHEREAS, this request was made despite the County Administration's previous guidance that, in view of declining General Fund revenues, General Fund agencies should submit a budge request reflecting a 5% reduction; and,
WHEREAS, if the County is required to fund the Circuit Court's operations for 2009 at the level of its budget request, drastic, disproportionate cuts will be required of all other General Fund agencies in order to balance the budget as required by law; and,
WHEREAS, if such drastic, disproportionate cuts are required, the County will be forced to significantly reduce the level of statutorily required services it provides to the citizens of Jackson County; and,
WHEREAS, such service reductions would not be in the best interests of the health, welfare, and safety of the citizens of Jackson County; and,
WHEREAS, the County Counselor has advised that the authorized method of challenging the Circuit Court's budget request is the filing of a Petition for Review with the Missouri Judicial Finance Commission pursuant to section 50.640, RSMo Supp. 2007; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be, and hereby is, authorized to file a Petition for Review with the Missouri Judicial Finance Commission concerning the Circuit Court of Jackson County's 2009 budget request.
