BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for 25 years to operate a 258-ft. (250-ft. guyed tower, 8-ft. lightning rod) above ground commercial communication tower subject to restrictions attached, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:
A 2.55 + acre area of land generally located 1/4 + mile east of Hoover Road on the north side of US Highway 24 (westbound lane) and fully described a tract of land located in the south half of Section 17, Township 50, Range 30, Jackson County, Missouri being more particularly described as follows: commencing at the southwest corner of the southeast quarter of said Section 17; Thence N 00ø 09' 51" E along the west line of the southeast quarter of said Section 17 a distance of 1044.05 feet thence S 89ø 50' 09" E a distance of 137.64 feet to the point of beginning of the tract of land to be described; thence N 30ø 05' 03" W a distance of 332.04 feet; thence N 00ø 53' 54" W a distance of 55.09 feet; thence N 89ø 06' 06" E a distance of 390.78 feet; thence S 00ø 53' 54" E a distance of 344.98 feet; thence S 89ø 06' 06" W a distance of 228.87 feet to the point of beginning.
Section 2. The Legislature, pursuant to the application of Sprint Spectrum (CU-96-009), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously failed to recommend approval of this application in a public hearing on August 15, 1996, does adopt this ordinance pursuant to the Jac...
