Body
WHEREAS, the City of Independence has requested an easement to allow the installation of a new sewer line across a portion of the County's Little Blue Trace Park, to serve the new Kidwell Business Park development north of 39th Street in City of Independence; and,
WHEREAS, the aforementioned easement is necessary in order to run the sewer line to the nearest metering station and there is no practical way to avoid the use of the County park property; and,
WHEREAS, the granting of this easement is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute a temporary construction easement in favor of the City of Independence, in a form substantially similar to that attached, as approved by the County Counselor.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
