Body
WHEREAS, Eastland Center Associates, L.L.C. is developing a section of the old Crackerneck Country Club in Independence, adjacent to the County's Little Blue Trace Park; and,

WHEREAS, Eastland has requested a permanent easement over approximately 1.85 acres of park land for the purpose of constructing a detention basin to capture surface run-off; and,

WHEREAS, in exchange, Eastland is offering an easement across 1.85 acres of the country club, now owned by Crackerneck Country Club, Inc., and under option to Eastland, to allow the County to extend its bicycle trail into this area, as well as additional easement across the country club grounds, to allow for access by County maintenance equipment; and,

WHEREAS, the easements, copies of which are attached, are permanent and will
run with the land when title passes; and,

WHEREAS, in connection with its proposed development, Eastland is also planning to build a bridge over the Little Blue River on Valley View Parkway Road; and,

WHEREAS, in connection with this construction, Eastland must acquire title to .42 acres of park property; and,

WHEREAS, because this park property was acquired with federal funds from the National Parks Service, the County may transfer title to this property only if the property at the same time acquires title to replacement property of equal or greater value; and,
