WHEREAS, there is now pending in the Probate Division of the Circuit Court of Jackson County the case of Rove v. Richards, et al., case no. 94-164552-09; and,
WHEREAS, in this case, the Public Administrator has alleged that certain former employees of her office have converted assets belonging to the estates of 19 wards of the office, to the former employees' own use; and,
WHEREAS, the County Counselor's office is defending the County's interest in this matter and recommends that the claims of these 19 estates be settled for the total payment of $40,379.89; and,
WHEREAS, the settlement recommended by the County Counselor is in the best interests of the health, welfare and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be and hereby is authorized to settle the case of Rove v. Richards, no. PR-164551-09, now pending in the Circuit Court of Jackson County, Probate Division, for the total payment of $40,379.89; and,
BE IT FURTHER RESOLVED that the County Counselor be and hereby is authorized to execute any and all documents necessary to effectuate the settlement; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance be and hereby is authorized to issue a check or checks totalling $40,379.89, according to the specific instructions of the County Counselor...Attorney
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
