Title
AN ORDINANCE approving a conditional use permit for the operation of a day care center as to a certain 3.3 + acre tract.

ORDINANCE 2881, December 15, 1998

Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for ten years for the operation of a day care center, subject to the restrictions specified below, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:
Requesting a conditional use permit (CUP) in District RU (Residential Urban) for a period of 15 years to operate a day care center subject to conditions on a 3.3 ñ acre tract of land.

Description: A 3.3 ñ acres generally located « of a mile east of Woods Chapel Road on the north side of Vesper Road lying in Section 35, Township 49, Range 31 in Jackson County, Missouri and more specifically described in two tracts as follows: The first tract beginning in southeast corner of northeast, northeast of Section 35 the west 220 feet then north 594 feet then east 220 feet then south 594 feet to point of beginning and the second tract being 75 feet x 200 feet in the southwest corner of section 36 of the west 15.83 acres of the northwest, northwest aka 2607 W. Vesper.


RESTRICTIONS

1. That the applicant comply with all local, State and Federal laws and regulations relative to the type of Day Care Center being or proposed to be operated under this Conditional Use Permit. The applicant shall provide a copy of the State annual sanitation inspection report for license exempt facilities to the Public Works Development Division.

2. That the Child Day Care Center shall be limited to the maximum number of children permitted by the Missouri Department of Health or 45 children whichever number is less.
