Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit for a period of 10 years to operate a child day-care center, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:
DESCRIPTION:

A 0.48 ± acre tract of land generally located on the north side of Duncan Road ½ mile east of R.D. Mize Road lying in Section 26, Township 49, Range 31 in Jackson County Missouri and legally more specifically described:

BEG AT PT IN CEN LI OF RD MIZE RD, SD PT BNG 1157' E OF W LI OF NE 1/4 TH N 270' TH N 288' TH S 270' TO PT IN SDRD TH E 88' TO BEG, aka 3255 NW Duncan Rd.


Section 2. The conditional use permit granted by this ordinance is subject to the following conditions:

1) That all conditions contained within Section 25005.6 of the Unified Development Code, relating to Child Day Care Centers be complied with.

2) That the applicant submit copies of all licenses from the Missouri Department of Health and State Fire Marshall's Office, and any other agency as required by law, as well as all renewals.

3) That the applicant provide the Environmental Services Division a letter from a Missouri licensed Engineer stating the current condition of the on-site system as well as any repairs or replacement requirements, if needed, in order to accommodate the proposed use and approvals obtained from the Environmental Services Division.

4) That all driveways and parking areas located on subject tract be surfaced and paved.

5) The outdoor play area of the child day care center shall be enclosed with a fence, which shall be build and maintained to a minimum height of four (4) feet.
