WHEREAS, the Director of Public Works has solicited formal written bids on Bid No. PW 03-2010 for the 2010 Pavement Maintenance Project Phase 1 (Asphaltic Concrete Overlay, Chip Seal, and Pavement Marking), No. 3126; and,

WHEREAS, he has received five (5) responses as follows:

Kansas City (Jackson County), MO

Metro Asphalt, Inc. $1,885,038.19
Independence, MO

Little Joes Asphalt, Inc. $1,909,734.34
Bonner Springs, KS

APAC-Kansas City, Inc. $2,013,736.23
Overland Park, KS

Miles Excavating, Inc. $2,026,425.35
Basehor, KS

and,
WHEREAS, the County reserved the right to adjust the quantities up or down to any and all bids to accommodate available funds within the bid specifications; and,

WHEREAS, the bids came in under the available funds and both Public Works and the Parks and Recreation Departments desire to increase the contract award within the budgeted funding to pay for two (2) additional miles of asphalt overlay and parking lot repairs in the Longview Lake area; and,

WHEREAS, the Director of Public Works recommends that the contract be awarded to Superior Bowen Asphalt Co., LLC, for the reason that it has submitted the lowest and best bid; and,
