Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,

WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,

WHEREAS, the Purchasing Director recommends a contract with Dean Machinery Company of Kansas City, MO, for the furnishing of Caterpillar equipment parts and service for use by the Public Works Department to provide for its needs for the upcoming one- year period; and,

WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that Dean Machinery Company of Kansas City, MO, is the only known supplier of Caterpillar equipment parts and service in the Kansas City metropolitan area; therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and hereby is, authorized to execute for the County any and all documents necessary to the accomplishment of the award; and,

BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, including final payment on the contract, to the extent sufficient appropriations to the using spending agency have heretofore been made in the current Jackson County budget...Attorney
