BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for five years to operate a child day-care center, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:

Section 2. The conditional use permit granted by this ordinance is subject to the following conditions:

1. That the applicant comply with all State and County regulations relative to a Child Day Care Center being operated under the Conditional Use Permit. Upon renewal of State and County Permits, the applicant shall provide copies to the Public Works Development Division.

2. That the Child Day Care Center shall be limited to an occupancy level of 30 people because of the on-site wastewater (septic) system.

3. That the on-site area designated for wastewater disposal be isolated to the extent that it will not be accessible to children.

4. That all driveways and parking areas located on subject tract be surfaced and paved.

5. The outdoor play area of the child day care center shall be enclosed with a fence, which shall be built and maintained to a minimum height of four (4) feet.

6. The Child Day Care Center shall be operated only between the hours of 6:00 a.m. and 6:00 p.m., Monday through Friday.
