Body
WHEREAS, in anticipation of a sale of certain property owned by Adams Farm, LLC ("Owner"), Owner has acquired rights to a necessary public right-of-way from the City of Blue Springs ("City"); and,

WHEREAS, the right-of-way was originally granted to Jackson County on January 21, 1942; and,

WHEREAS, the right-of-way property fronts on R. D. Mize Road to the west of Adams Dairy Parkway and is approximately 250 feet in length by 35 feet in width and contains 8750 square feet or 0.2008 acres, more or less; and,

WHEREAS, the area including the right-of-way was incorporated into Blue Springs, MO, in 1992; and,

WHEREAS, although the County's legal advisors believe that the incorporation ordinance transferred all rights to the right-of-way to the City of Blue Springs, title company underwriters and legal counsel for the Owner have requested that the County execute a quit-claim deed for the purpose of extinguishing or ceding any remaining County interest in the right-of-way so that the underlying property can be sold free of any claim of the County; and,

WHEREAS, the Public Works Director has no objection to ceding the right-of-way as there are no pending County projects that would require the use of the right-of way and recommends that the County Executive be authorized to execute a quit claim deed in a form to be approved by the County Counselor; and,

WHEREAS, the public interest will be served by permitting the underlying property to be sold without any cloud on its title; and,
