WHEREAS, the Good Ordinance proposes to prohibit law enforcement officers from concealing their faces or badges during performance of their official duties, with certain exemptions and penalties; and,
WHEREAS, the stated purpose of the proposed Good Ordinance is to strengthen transparency, accountability, and public trust in law enforcement; and,
WHEREAS, the routine use of face-coverings and badge-concealment by law enforcement officers may pose a threat to the health, safety, and welfare of the People of Jackson County; and,
WHEREAS, such routine use of face-coverings and badge-concealment by law enforcement officers may violate certain constitutional rights of Jackson County citizens, including but not limited to First and Fifth Amendments rights under the United States Constitution and rights under Article I, Sections 2, 8, 9, and 10 of the Missouri Constitution; and,
WHEREAS, after the Good Ordinance was proposed, similar laws and ordinances have been proposed or promulgated in other jurisdictions across the United States; and,
WHEREAS, the proposed and existing laws and ordinances in other jurisdictions are subject to pending and expected litigation; now therefore,
BE IT RESOLVED that the County Legislature of Jackson County, Missouri, hereby tables the Good Ordinance, Proposed Ordinance 6050, as amended, until the legislation and litigation in other jurisdictions may be appropriately considered; and
BE IT FURTHER RESOLVED that the County Legislature of Jackson County, Missouri, reserves the right to call the Good Ordinance up for expedited consideration as permitted by law in the event extenuating...
