WHEREAS, by Resolution 10683, dated February 21, 1995, the Legislature did authorize the County Executive to execute a quit-claim deed in favor of Stevinson Auto and Electrical School Co., concerning a small tract of land south of 39th Street and east of Selsa Road in the City of Independence, MO; and,
WHEREAS, this action was taken because Stevinson, the record owner of the tract, had been advised by its title insurer that a small portion of its property may be located in a former channel of the Little Blue River and that Missouri Law gives counties a claim to real property located within abandoned riverbeds; and,
WHEREAS, the Director of Parks and Recreation advised at the time, and continues to advise, that Stevinson's property is separate and apart from the County's Little Blue Trace Park, and that the department has no other use for the tract; and,
WHEREAS, the surveyor who prepared the legal description on the deed authorized by Resolution 10683 has now advised that that legal description contains errors which should be corrected; and,
WHEREAS, the attached revised Quit-Claim Deed provides a suitable mechanism for accomplishing this purpose; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached revised Quit-Claim Deed in favor of Stevinson Auto and Electrical School Co.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
