Body
WHEREAS, Missouri Alliance, LLC, dba Bluebird Fiber has requested a permanent utility easement for the purposes of installing fiber optic cable and conduit across a 14,236 square foot portion of Fleming Park adjacent to the Lake Vista Trail at the base of Lake Jacomo Dam for use by the Blue Springs School District; and,
WHEREAS, the Parks + Rec Department has determined that the permanent fiber optic utility easement will have no adverse effect on the use of the park, and that most of the project utilizes land within the right of way of Liggett Road and Woods Chapel Road; and,
WHEREAS, Missouri Alliance, LLC, dba Bluebird Fiber will pay the County the sum of $7,694.40 for the easement which includes a $2,000.00 administrative fee and an easement fee of $5,694.40 (.40/square foot); now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, the permanent utility easement is hereby approved, and that the County Executive is hereby authorized to execute the easement on behalf of the County.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
