Body
WHEREAS, the County entered into an Intergovernmental Cooperative Agreement with the City of Lee's Summit ("City") on November 15, 1999 for the sharing of the costs of Colbern Road Phase II improvements associated with Project No. 2411; and,

WHEREAS, that Agreement provided that the County is responsible for the administration and project management, bidding, construction, and inspection of the project; and that the City will maintain the project improvements after final acceptance of the project, as well as reimburse the County for the City's portion of the project costs from the City's portion of the County Road and Bridge Funds; and,

WHEREAS, based upon the bids received by the County, the total project cost has increased from $4,480,000.00 to $6,437,013.43, increasing the City's portion of the project costs by $798,506.72; and,

WHEREAS, the County and the City now desire to have the City reimburse the County for these additional costs from the City's portion of the County Road and Bridge Funds according to the terms further described in the Modification No. 1 to the Agreement, attached hereto and incorporated herein by reference as Exhibit 1; and,

WHEREAS, the City has authorized the execution of the proposed modification; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute Modification No. 1 to Intergovernmental Cooperative Agreement.
