Body
WHEREAS, when the village of Tarsney Lakes was disincorporated in 1984, certain improved real property owned by Tarsney Lakes Homes Association, Inc., was conveyed to the Lotawana Fire Protection District for use as a fire station; and,

WHEREAS, the deed for this conveyance contains a reversionary interest which specifies that, in the event that the property is no longer used to provide fire protection, the property shall revert to Jackson County; and,

WHEREAS, the District formerly used the property as a fire station and more recently used it to store equipment; and,

WHEREAS, due to its deteriorated condition, the District no longer has a need for the building and can provide adequate fire protection to the residents of the area through its other facilities; and,

WHEREAS, the District has requested that the County quit-claim its reversionary interest in the building so that the District can sell the building and apply the proceeds of the sale to its fire protection activities; and,

WHEREAS, the attached quit-claim deed provides a suitable mechanism by which to effect this arrangement; and,

WHEREAS, the execution of this quit-claim deed is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached quit-claim deed in favor of the Lotawana Fire Protection District...Attorney
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
