Body
WHEREAS, the County desires to enter into an agreement for the harvesting of crops including corn and soybeans, located within Longview and Monkey Mountain Parks for the Fall 2004 harvest season; and,

WHEREAS, a prior lease agreement which included such services has been breached by the lessee and litigation is anticipated; and,

WHEREAS, the timely harvesting of the crops is necessary to protect the County's interests and to mitigate damages to the County; and,

WHEREAS, the County has reached an agreement in principle with a L. E. Montgomery that he will harvest the crops based upon a split of the harvest proceeds; and,

WHEREAS, the County proposes to split the harvest proceeds with L. E. Montgomery based on a harvesting fee of $30.00 per acre plus $0.25 per bushel for hauling grain to a grain elevator and payable from the net proceeds by the grain elevator; and,

WHEREAS, execution of this agreement as an emergency purchase pursuant to Section 1062 of the Jackson County Code, 1984, is in the best interest of the health, safety, and welfare of the citizens of the County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute an agreement with L. E. Montgomery, in a form to be approved by the County Counselor.

Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
