Body
WHEREAS, the County has created a sanitary sewer district pursuant to Sections 249.430 et seq., RSMo, in the Blue Summit area known as Sewer District 98; and,

WHEREAS, the City of Kansas City has been providing wastewater transportation and treatment services for this district; and,

WHEREAS, the County wishes to divest itself of maintenance responsibility for its sanitary wastewater collection systems; and,

WHEREAS, the City has agreed to accept this responsibility as to Sewer District 98; and,

WHEREAS, to effect this agreement, the City and the County have negotiated the attached Cooperative Agreement; and,

WHEREAS, they have also reached an agreement in principle regarding the terms of a Transfer Agreement and quit claim deed between the parties; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Cooperative Agreement, Transfer Agreement, and Quit Claim Deed are hereby approved, and that the County Executive be and hereby is authorized to execute on behalf of the County the attached Cooperative Agreement and a Transfer Agreement and quit claim deed in a form to be approved by the County Counselor; and,

BE IT FURTHER RESOLVED that the County hereby agrees to enforce the City of Kansas City, Missouri sewer use regulations, City Code - Chapter 60 and any further amendments within Sewer District 98.
