AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) for a period of ten (10) years to continue operation of a private aviation field on seventy (70) ± acres, subject to conditions.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for a private aviation field.
WHEREAS, the 70± acres are generally located 1/4 ± of a mile east of Missouri F Highway on the North side of J.W. Cummins Road and is legally described as the South 70 acres of the East ½ of the Southwest quarter of Section 21, Township 48, Range 29 in Jackson County, Missouri a.k.a. 39202 J.W. Cummins Road; and,
WHEREAS, the Jackson County Plan Commission, on January 20, 2005 held a public hearing and accepted testimony pertaining to the conditional use permit requested by Lee Roy and Mary Thomas. This request to continue operating a private aviation field will not seriously injure the appropriate use of neighboring property and conforms to the general intent and purpose of the Unified Development Code. Therefore, the Plan Commission voted 8 to 0 to recommend approval for a ten (10) year period provided the following five (5) conditions are met:
The aviation field (airstrip) be used for the applicant's private use and not as a commercial operation.
The aviation field (airstrip) and its support facilities be limited to only the applicant's airplane.
The aviation field (airstrip) shall include all approach and departure paths as necessary to assure a safe and adequate landing and take off area.
Adequate safety provisions shall be provided which control or restrict access by the general public to the landing and take off areas.
The landing and take off area shall be maintained as a grass turf surface to avoid the blowing of dust or dirt onto neighboring property.
