RESOLUTION # 10715, March 13, 1995 INTRODUCED BY Dennis Waits, County Legislator Body WHEREAS, by Resolution 10435, dated August 15, 1994, the Legislature did authorize the County Executive to execute a Deed Without Warranty in favor of the United States of America, the first step necessary to effect the transfer of title to the County's La Benite Park to the City of Sugar Creek; and,

WHEREAS, since the adoption of Resolution 10435, the approval of the proposed transfer has been under review by the United States Department of the Interior, such that the deed authorized by the Resolution has not yet been executed and delivered; and,

WHEREAS, the Missouri Highway and Transportation Commission is in need of easements and rights-of-way across La Benite Park for the construction of a new bridge across the Missouri River on M-291 Highway; and,

WHEREAS, until the conveyance of the park to the United States is accepted by the United States, the park remains the property of the County such that only the County can convey to the State of Missouri the necessary rights-of-way and easements; and,

WHEREAS, neither the United States nor the City of Sugar Creek objects to the proposed conveyance; and,

WHEREAS, the conveyance of the proposed easements and rights-of-way to the State of Missouri is in the best interest of the health, safety, and welfare of the citizens of Jackson County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached General Warranty Deeds in favor of the Missou...
