BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit is hereby needed for a period of 15 years for continued operation of a childcare center on .49 ± tract at 3255 NW Duncan Road, and legally described as follows:
Description: Part of the Northeast Quarter of Section 26, Township 49, Range 49, Jackson County, Missouri, described as follows: Beginning at a point in the centerline of R. D. Mize Road, said point being 1157 feet East of the West line of the Northeast Quarter of Section 26; thence North 270 feet; thence West 88 feet; thence South 270 feet to a point in the center of R. D. Mize Road; thence East 88 feet to the Point of Beginning. Except that part in R. D. Mize Road.
Section 2. The conditional use permit granted by this Ordinance is subject to the following conditions:
1) That all conditions contained within Section 24005.6 of the Unified Development Code are in compliance, relating to Child Day Care Centers.
2) That the applicant submit copies of all licenses upon renewal from the Missouri Department of Health and Senior Services and any other agency as required by law to the Planning and Environmental Health Division.
3) That all driveways and parking areas located on subject tract be surfaced and paved.
4) The outdoor play area of the child day care center shall be enclosed with a fence, which shall have a minimum height of four feet.
5) The septic tank and propane tank shall be enclosed with a fence that has a minimum height of four feet and be inaccessible to children.
