AN ORDINANCE appropriating $145,605.00 from the unappropriated surplus of the 2006 Recorder's Technology Fund and $43,737.11 from the unappropriated surplus of the 2006 Recorder's Fee Funds and awarding a contract for the furnishing of automated indexing software and software upgrades for use by the Records Department to Hart Intercivic, Inc., of Austin, Texas, at a cost to the County not to exceed $189,342.11, as a sole source purchase.

Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $25,000.00; and,
WHEREAS, the Director of Finance and Purchasing recommends a contract with Hart Intercivic, Inc., of Austin, Texas, for the furnishing of automated indexing software and software upgrades for use by the Records Department; and,
WHEREAS, the Director of Finance and Purchasing further recommends that she not take competitive bids with regard to said contract for the reason that Hart Intercivic, Inc., of Austin, Texas, is the only known supplier of automated indexing software and software upgrades for its own proprietary Hart Intercivic records software; and,
WHEREAS, an appropriation is necessary in order to place the required funds in the proper spending account; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the unappropriated surplus of the 2006 Recorder's Technology Fund and the 2006 Recorder's Fee Funds be and hereby is made:
