BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for 25 years to operate a 128-ft. (120-ft. monopole tower, 8-ft. lightning rod) above ground commercial communication tower subject to restrictions attached, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:
A 0.30 + acre tract of land generally located 0.7 miles east of Buckner-Tarsney Road on the north side of US Hwy. 50 and fully described as being circular in shape and located in the southeast quarter of the southwest quarter of Section 14, Township 47, Range 30, Jackson County, Missouri described as follows: Commencing at the southwest corner of the southeast quarter of the southwest quarter of said section 14; thence N 89ø 58' 50" E along the south line of the southwest quarter of said section 14 a distance of 133.75 feet; thence N 00ø 03' 10" W a distance of 188.94 feet to the point of beginning; thence on a curve of the left with a radius of 64.00 feet and an arc distance of 402.12 feet, and a central angle of 360ø 00' 00" terminating at the point of beginning containing 12,868 square feet more or less.
Section 2. The Legislature, pursuant to the application of Sprint Spectrum (CU-96-008), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission, by a vote of three to two, recommended approval of this application in a public hearing on August 15, 1996, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature t...
