AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) for a period of five (5) years to operate a therapeutic horseback riding center and horse boarding facility on a 10 ± acre tract .

Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit is hereby granted for a period of five (5) years to operate a therapeutic horseback riding center and horse boarding facility as to an approximate 10+ acre tract located 1/10 mile east of Hamilton Road on the south side of Stringtown Road legally described as follows:
Description: All of the Northeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 34, Township 47, Range 30, Jackson County, Missouri, except that part in Stringtown Road, aka 31595 E. Stringtown Road.

Section 2. The conditional use permit granted by this Ordinance is subject to the following conditions:
1. The number of horses boarded shall be limited to no more than 3 at any one time.

2. No horse shows, commercial concession stands or tack store shall be provided on the premises.

3. All lighting for the outdoor arena/parking lot shall be turned off no later than 9:00 p.m. each night.

4. The applicant shall only provide equestrian classes to children and adults with special needs in compliance with IRS Code 501©)(3).



Section 3. The Legislature, pursuant to the application of the Helping Hands Riding Center (CU-2007-200), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted unanimously to recommend approval of this application in a public hearing on December 20, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
