BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit is hereby granted for a period of twenty (20) years to continue operation of a Day Care Center for school age children at the Elm Grove Elementary School on a situs described as twelve (12) ± acres generally located at the northeast corner of Kentucky and Whitney Roads and is legally described as follows:
All that part of the Southwest Quarter of Section 20, Township 50, Range 31 in Jackson County, Missouri, described as follows: Beginning at a point 25 East and 40 feet North of the Southwest corner of the Southwest Quarter of Section 20, Township 50 Range 31; thence North 0 degrees, 08 minutes, 36 seconds West parallel with the West line of said Quarter Section 723.00 feet; thence South 89 degrees, 59 minutes, 44 seconds East, parallel with the South line of said Quarter Section 723.00 feet; thence South 0 degrees, 08 minutes, 36 seconds, East 723.00 feet to a point 40.0 feet North of the South line of said Quarter Section; thence North 89 degrees, 59 minutes, 44 seconds West 723.00 feet to the point of beginning. Containing 12.0 acres, subject to that part in roads, a/k/a 18000 Kentucky Road.
Section 2. The Legislature, pursuant to the application of the Fort Osage School District (CU-2005-188), and with notice that the Jackson County Plan Commission, on March 17, 2005, held a public hearing and voted 5 to 0 to recommend APPROVAL for a twenty (20) year period, hereby adopts this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislat...
