Body
WHEREAS, the installation of new flashing light signals and gates with redundant constant warning time circuitry appears to be warranted at an existing grade crossing in Jackson County, Missouri, where Atherton-Sibley Road intersects the Burlington Northern and Santa Fe Railway Company tracks at a crossing identified as DOT #005 368U; and,
WHEREAS, the Missouri Highway and Transportation Commission requests the cooperation of Jackson County in upgrading these railroad signs; and,
WHEREAS, the Missouri Highway and Transportation Commission will utilize federal funds to pay for 90% of the upgrade, the Burlington Northern and Santa Fe Railway Company will pay 10%, and Jackson County will agree to maintain the warning signs and pavement markings; and,
WHEREAS, improvements made to this railroad crossing will increase safety and benefit the citizens of Jackson County; and,
WHEREAS, the attached Agreement will secure the funding for improvements and confirm the understanding of the parties; therefore,
BE IT RESOLVED, by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached agreement with the Missouri Highway and Transportation Commission and The Burlington Northern and Santa Fe Railway Company.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
