Body
WHEREAS, staff of the Public Works Department have completed an exhaustive review of the County’s existing on-site sewage disposal rules and regulations in order to comply with the minimum requirements of the Missouri Division of Health, as required by §701.035, RSMo 2000; and,

WHEREAS, § 24006.4.8 of the County’s Unified Development Code provides for the promulgation of on-site sewage disposal rules and regulations by the Director of Public Works and approval of same by the Legislature; and,

WHEREAS, the Public Works Department’s Environmental Health Division currently provides on-site sewage disposal system permits and inspections throughout the County except for within the cities of Independence, and Kansas City, Missouri; and,

WHEREAS, § 192.280, RSMo 2000 provides that it is the duty of the County Health Officer to enforce the rules and regulations of the Missouri Division of Health; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the 2002 on-site sewage disposal rules and regulations promulgated by the Director of Public Works be and hereby are approved.

Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
