Body
WHEREAS, by Resolution 11368, dated July 22, 1996, the County did execute a lease with K.C. Partners for office space in the Oak Tower Building to accommodate the Public Defender's office, at a total cost of $2,983,283.85 over the life of the lease including all renewal terms; and,
WHEREAS, the proposed Amendment No. 2 is necessary to modify certain provisions of original lease agreement including changing the options to extend the lease from two 5-year options to two 1-year options, and extending the term of the lease for an additional twelve months at a first year cost to the County of $167,960.00, and an estimated second year cost of $181,740.00, and changing the base year for calculation of pass-through costs from 1996 to 2003; and,
WHEREAS, the proposed amendment would result in estimated savings to the County of $32,630.00 in 2004 and $27,820.00 in 2005 if the second 1-year option is exercised; and,
WHEREAS, the attached Amendment No. 2 adequately sets out the rights and obligations of the parties; now therefore,
BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Amendment No.2 to the lease with K.C. Partners; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance be and hereby is authorized to make all payments on the lease as amended to the extent that sufficient appropriations to the using spending agency are contained in the then current Jackson County budget.
