Body
WHEREAS, by Resolution 11368, dated July 22, 1996, the County did execute a lease with K.C. Partners for office space in the Oak Tower Building to accommodate the Public Defender's office, at a total cost of $2,983,283.85 over the life of the lease including all renewal terms; and,

WHEREAS, by Resolution 14826, dated December 8, 2003, the County did execute Amendment No. 2 extending the term of the lease for twelve months with an option to extend for an additional twelve months, at an additional cost to the County of $167,960.00 in 2004; and,

WHEREAS, the proposed amendment is necessary to exercise the option to extend through December 31, 2006, with an option to extend at the same monthly rate for an additional twelve months; and,

WHEREAS, the attached Amendment No. 3 adequately sets out the rights and obligations of the parties; now therefore,

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Amendment No.3 to the lease with K.C. Partners; and,

BE IT FURTHER RESOLVED that the Director of Finance and Purchasing be and hereby is authorized to make all payments on the lease as amended to the extent that sufficient appropriations to the using spending agency are contained in the then current Jackson County budget.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
