Body



BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit for 90 years to operate a 145-ft. (140-ft. self- supporting tower, 
5-ft. lightning rod) above ground commercial construction tower subject to restrictions attached, 
under the Unified Development Code, is hereby approved as to a certain tract of land described as 
follows:
A 0.51 + acre tract of land generally located less than 1/2 mile west of Tyer Road on the South 
side of Duncan Road (Missouri Public Service Property) and fully described as being circular in shape 
and located in the NE 1/4 of Section 28, Township 49 North, Range 30 West, Jackson County, 
Missouri: Commencing at the Northwest corner of the NE 1/4 of said Section 28: Thence S 87x 51' 
18" E along the north line of said NE 1/4 a distance of 213.40 feet; thence S 02x 08' 42" W a distance 
of 844.43 feet to the POB; thence on a curve to the right with a radius of 84 feet and an ARC 
Distance of 527.78 feet, and a central angle of 360x 00' 00", Terminating at the POB and containing 
22,187 square feet more or less.

Section 2. The Legislature, pursuant to the application of Sprint Spectrum (CU-96-006), requesting 
approval embodied in this ordinance and with notice that the Jackson County Planning Commission 
recommended unanimous approval of this application in a public hearing on June 20, 1996, does 
adopt this ordinance pursuant to the Jackson County...
