Body

WHEREAS, by Resolution 15829, dated March 20, 2006, the Jackson County Legislature did authorize and direct the County Counselor to institute condemnation proceedings as to a certain tract of land required for the Liggett Road Improvements, Project No. 2449, and authorized the Director of Public Works to continue negotiations with owners, Kevin S. and Patricia S. Hennrich; and,

WHEREAS, pursuant to continued negotiations, Kevin S. and Patricia S. Hennrich, the owners of property identified as project tract No. LR-02 (tax parcel 42-600-02-15-00-0-00-000) have agreed to convey the necessary right-of-way and easements to Jackson County, Missouri for the sum of $50,000.00; and,

WHEREAS, the Director of the Department of Public Works recommends the payment of $50,000.00 to Kevin S. and Patricia S. Hennrich in a one-time lump sum; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Director of Finance and Purchasing be and hereby is directed to issue a lump sum payment in the amount of $50,000.00 to Kevin S. and Patricia S. Hennrich in consideration for easement and right of way conveyances, pursuant to the specific direction of the County Counselor; and,

BE IT FURTHER RESOLVED that the County Counselor be and hereby is authorized to execute any and all documents necessary to the accomplishment of this negotiated settlement.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
