Body
WHEREAS, the Jackson County Rock Island Corridor crosses Kanas City Southern Railroad (KCSR) at the location north of Manchester Trafficway in Kansas City, MO, and the KCSR has a project to construct a segment of additional tracks for trains to pass in that area; and,
WHEREAS, the Cooperative Agreement grants permission for KCSR to remove the
bridge and structures within KCSR existing right of way, and KCSR has funds to remove the bridge and structures; and,
WHEREAS, this project requires the removal of piers, superstructure and bridges of the former Kansas City Rock Island Railroad (KCRIR); and,
WHEREAS, the KCSR provided records of a 1904 agreement with the KCRIR to Jackson County and the agreement provides permission to remove the bridge if any project is required by the KCSR in the area; and,
WHEREAS, the Parks + Rec Department requests the approval of the attached Cooperative Agreement with Kansas City Southern Railroad; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri that the County Executive be and hereby is authorized to execute the attached Cooperative Agreement with Kansas City Southern Railroad, on behalf of the County.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
