Body
WHEREAS, the County has owned Tarsney Lake, Wood Lake and other common areas in the Tarsney Lakes community since the Village of Tarsney Lakes was disincorporated in 1984; and,

WHEREAS, it is in the best interests of the health, safety, and welfare of the citizens of Jackson County that swimming and boating on these lakes be regulated; now therefore,

Section A. Enacting Clause. Sections 5561. and 5562., Jackson County Code, 1984, are hereby enacted, to read as follows:

5561. Swimming.
No person shall swim, bathe, wade, or float in or on any non-licensed floatation device, on Tarsney Lake, Wood Lake, or any other waterway owned by the county outside the county park system, except that persons wearing type I, II, or III personal floatation devices approved by the United States Coast Guard may swim from a moored boat.

5562. Boating.
No person shall operate a gasoline-powered boat or other watercraft on Tarsney Lake, Wood Lake, or any other waterway owned by the county outside the county park system.

Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
