Body
WHEREAS, under article IX, section 2, of the Jackson County Charter, one assistant and one secretary to the Sheriff are exempt from the provisions of the Merit System; and,

WHEREAS, that same section provides that additional exemptions from the Merit System can be approved by the Legislature upon recommendation of the Merit System Commission; and,

WHEREAS, the Sheriff's exempt "assistant" has by tradition been his second-in-command, or undersheriff; and,

WHEREAS, the Sheriff has proposed to organize his staff with two undersheriffs, each with separate responsibilities, and has requested that both undersheriffs, or assistants, in the interest of fairness and equal treatment, be exempt from the provisions of the Merit System; and,

WHEREAS, at its regular meeting of January 7, 2009, the Merit System Commission considered this request, and pursuant to article IX, section 2, of the Charter, has recommended the additional exemptions to the Legislature; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that, pursuant to article IX, section 2 of the Charter, the exemption of an additional assistant to the Sheriff from the provisions of the Merit System, be and hereby is authorized.

Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
