Body
WHEREAS, section 1139., Jackson County Code, 1984, requires a reimbursement to the County of its acquisition cost when a Sheriff's Office's K-9 unit dog is retired or relieved from duty due to age or injury, in order for the dog's handler to take ownership of the dog; and,
WHEREAS, K-9 unit member Speedy was acquired by the Sheriff's Office in 2002 at a cost of several thousand dollars; and,
WHEREAS, in April 2007 Speedy was diagnosed with a severe case of pneumonia and immediately began treatment which lasted several weeks and resulted in a diagnosis of "long term residual damage" by Dr. David Theiss, DVM, of the Lee's Summit Animal Hospital; and,
WHEREAS, Speedy has just over 50% lung capacity with little to no chance of improvement; and,
WHEREAS, Speedy has been a loyal protector and companion to his handler, Deputy Glen Postlethwait, who is now requesting that he be allowed to care for Speedy at his own expense; and,
WHEREAS, Speedy will require further medical attention after he is retired and Deputy Postlethwait would suffer severe financial hardship if he is required to both reimburse the County for the acquisition cost and to pay for Speedy's veterinary and other care; and,
WHEREAS, the Sheriff recommends the waiver of the reimbursement requirements of section 1139. to enable Deputy Postlethwait to care for a valued canine member after retirement; now therefore,
BE IT ORDAINED by the County Legislature that the reimbursement of acquisition cost required by section 1139., Jackson County Code, 1984...
