A RESOLUTION authorizing the County Executive to execute a permanent easement agreement in favor of Southwestern Bell for construction of an equipment station at Fleming Park.

Body
WHEREAS, by Resolution 8847, dated June 17, 1991, the Legislature authorized the County Executive to execute a permanent easement in favor of Southwestern Bell for the installation of an equipment cabinet for its fiber optic cable system, at the intersection of Colbern and Blackwell Roads in Fleming Park; and,
WHEREAS, Southwestern Bell has requested an expansion of its existing easement by the inclusion of an adjacent 10' by 15' plot; and,
WHEREAS, the grant of this easement will not harm the park and is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute an easement in favor of Southwestern Bell, to carry out the above stated purposes in the form attached hereto.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
