Body
WHEREAS, 56.312 and 136.150, RSMo 1994, authorize the Prosecuting Attorney to receive a fee for the collection of any back tax, fee, or license, owing to the State of Missouri, in the amount of 10% of the sum collected; and,

WHEREAS, these fees accrue from year to year in the Prosecuting Attorney's Sales Tax Collection Fee Fund and, pursuant to 56.312, are not subject to reappropriation; and,

WHEREAS, the Prosecuting Attorney historically has expended monies in this fund infrequently, generally for equipment such as computers and automobiles; and,

WHEREAS, the salaries and expenses of the personnel within the Prosecuting Attorney's office who actually collect these fees are presently paid out of the County's General Fund; and,

WHEREAS, the Prosecuting Attorney now recommends that the responsibility of bearing these salaries and expenses be shifted from the General Fund to the Sales Tax Collection Fee Fund, where it rightly belongs; and,

WHEREAS, this proposed shift will make available General Fund monies which can then be used to hire additional staff to assist in the office's ever-increasing workload; and,

WHEREAS, in order to implement the Prosecuting Attorney's recommendation, a transfer within the 1999 Back Tax Collection Fee Fund is necessary; and,

WHEREAS, the County Executive recommends such transfer; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be and hereby is made within the 1999 Sales Tax Collection Fee Fund:
