Body
WHEREAS, the County has created sanitary sewer districts pursuant to 249.430 et seq., RSMo, in the Farview Heights, Farview North, Salem East, New Salem, Elm Grove, and Osage Manor subdivisions in the unincorporated County, adjacent to the City of Independence's city limits; and,

WHEREAS, the County does not operate an extensive sanitary sewer system in the unincorporated area of the County and does not provide water or other essential services to the residents of these subdivisions, making collection of delinquent accounts difficult; and,

WHEREAS, the City does operate an extensive sanitary sewer system and provides water to the residents of Farview Heights, Farview North, Salem East, New Salem, Elm Grove, and Osage Manor; and,

WHEREAS, it is the desire of the County and the City agrees to have City assume control, operation, and maintenance of the sewerage systems in the Farview Heights, Farview North, Salem East, New Salem, Elm Grove, and Osage Manor sewer districts; and,

WHEREAS, the attached Cooperative Agreement provides a satisfactory mechanism by which to accomplish this purpose; and,

WHEREAS, this Agreement is in the best interest of the health, welfare, and safety of the citizens of the County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Cooperative Agreement with the City of Independence, Missouri; and,
