Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit (CUP) is hereby granted for a period of ten (10) years to operate a dog kennel as to a 10 + acre tract, described as follows:
Description: A 10 ± acre tract of land generally located less than ¼ of a mile south of Hostetter Road on the west side of Koger Road and specifically described as all of the north half of the south half of southeast quarter of the northeast quarter of Section 1, Township 50, Range 31, except that part in Koger Road along the east boundary aka 4220 N. Koger Road.


Section 2. The CUP granted by this Ordinance is subject to the following conditions:
The kennel shall be limited to Chihuahua and American Staffordshire Terrier dogs only, with the maximum number to be kept on the property at any one time limited to fifteen (15).
The kennel shall be private and limited to only the property owner's dogs and shall not be operated as a boarding/commercial animal establishment.
There shall be no on-premise signage allowed for either identification or advertisement purposes.
All dogs must be contained in the residence or the fenced area unless under the control of and obedient to the command of a responsible person.

Section 3. The Legislature, pursuant to the application of James DonCarlos (CU-2007-195), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on February 15, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to plann...
