Body
WHEREAS, the City of Sugar Creek, Missouri, has entered into or will enter into a development agreement and certain other agreements for public purposes pursuant to Chapter 100 of the Revised Statutes of Missouri, under which it will issue revenue bonds to acquire certain real estate and personal property to be leased to Lafarge Corporation for industrial development purposes; and,

WHEREAS, pursuant to these agreements, Lafarge has agreed or will agree to make certain payments to the City, some of which payments are designated in the agreements as "payments in lieu of taxes" which are to be allocated among and distributed to the political subdivisions in which the leased property is located, including but not limited to the County and the Fort Osage School District; and,

WHEREAS, the Director of Collection has agreed to collect the payments from Lafarge on behalf of the City and distribute them among the political subdivisions in which the leased property is located, including a portion which will be payable to the School District; and,

WHEREAS, the attached Revenue Distribution Agreement provides a suitable mechanism by which these payments can be collected from Lafarge and distributed to the School District and other political subdivisions; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Revenue Distribution Agreement with the Fort Osage R-I School District...Attorney
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
