Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for ten years for the operation of a dog and cat boarding kennel, subject to the restrictions specified below, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:

A 10 ñ acre tract generally located 2/10 of a mile south of Hammond Road on the west side of Spainhour Road lying in Section 1, Township 47, Range 30 in Jackson County, Missouri and beginning at southeast corner of the west «, northeast 1/4 then north 40.39' then southwest 654.58 feet then north 393.8 ft. then west 103.75 feet then north 263 feet then east to east line of west « northeast 1/4 then south along southeast line to point of beginning (except part in roads), a/k/a 10810 S. Spainhour Road.


CU-98-034 (Charles Garrison)
Restrictions:

1) That all structures, enclosures, runways or exercising areas are located not less than 200 feet from all property lines.

2) That the number of dogs and cats kept at the kennel be limited to sixty (60).

3) That the kennel shall be operated as a boarding/commercial animal establishment as set forth in Chapter 45 of the Jackson County Code.

4) Upon renewal each year of the required state animal care facility license, the applicant shall forward a copy to the Public Works Development Division.

5) That all dogs and cats must be contained in the kennel facility unless under the control of and obedient to the command of any responsible person.
