A RESOLUTION authorizing the County Executive to execute a temporary construction easement in favor of Canadian Pacific Kansas City Railroad along a portion of the Rock Island Corridor, for a fee payable to the County.

Body
WHEREAS, the Canadian Pacific Kansas City (CPKC) Railroad has requested that the County grant a temporary construction easement along a portion of the Rock Island Corridor; and,

WHEREAS, if granted, CPKC Railroad's temporary easement will be 8,482.70 square feet; and,

WHEREAS, CPKC Railroad has determined that the temporary construction easement will provide the appropriate space for construction; and,

WHEREAS, CPKC has agreed to provide $20,000 to replace trees removed during construction; and,

WHEREAS, in addition CPKC Railroad will remove waste tires located in the area and replant with native wetland vegetation; and,

WHEREAS, CPKC Railroad will pay the County's administrative fee, of $2,000.00, and the $20,000.00 tree replacement fee, for a total paid to the County of $22,000.00, which will be paid upon execution of the agreements; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, and a temporary construction easement in favor of CPKC Railroad is hereby approved and that the County Executive is hereby authorized to execute the easement on behalf of the County.

Effective Date: This resolution shall be effective immediately upon its signature by the County Executive.
