Body
WHEREAS, the County's Lydia Avenue Bridge project is a City of Kansas City County Urban Road System (CURS) project, by which the Public Works Department will acquire right-of-way and improve the Lydia Avenue bridge over Indian Creek in south Kansas City; and,
WHEREAS, in connection with this project, the City is also interested in acquiring right-of-way from one of the same landowners from whom road right-of-way is required, for use as a recreational trail; and,
WHEREAS, CURS funds cannot be used to pay the acquisition costs of recreational trail right-of-way; and,
WHEREAS, in order to expedite the acquisition of the desired right-of-way, and to keep acquisition costs to a minimum, the City and Public Works Department have negotiated the attached Agreement, which provides for the acquisition of the trail right-of-way by the County, with the costs, now estimated at $96,000.00, to be reimbursed to the County by the City; and,
WHEREAS, the execution of this Agreement is in the best interests of the health, welfare and safety of the citizens of the County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Agreement with the City of Kansas City, MO.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
