IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE approving a conditional use permit for a sand and gravel dredging pit as to a certain 52 + acre tract. Intro ORDINANCE 2683, June 2, 1997 INTRODUCED BY Fred Arbanas, County Legislator Body BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows: Section 1. A conditional use permit for five years for a sand and gravel dredging pit, subject to the restrictions specified on the attached Request for Legislative Action, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows: A 52ñ acre tract of land generally located at the northeast corner of Missouri Highways 291 and 210 and more specifically described: Commencing at the Southeast corner of the Northwest quarter of Section 1, Township 50, Range 32; thence along the East line of said quarter section and along the East line of the West half of the West half of Section 36, Township 51, Range 32, north 1 degree 50 minutes East 2844.52 feet to the TRUE POINT OF BEGINNING of this tract: thence along the East and of said West half of West half of Section 36, North 1 degree 50 minutes East 1691.64 feet to a point on the Jackson-Clay County line as established by agreement by both counties in September, 1956 in Document No. 671774; thence along said county line North 73 degrees 37 minutes 48 seconds West 838.62 feet; thence North 86 degrees 12 minutes West 898.09 feet; thence South 82 degrees 36 minutes West 232.52 feet to a point on the Northeasterly right of way line of Missouri State Route 291; thence along said Northeasterly right of way line South 36 degrees 02 minutes 46 seconds East 87.29 feet to a point 225 feet opposite center line station 792+16.1 bk, which equals 2+0 AH; thence South 11 degrees 52 minutes 25 seconds East 400.78 feet to a point 200 feet opposite center line station 6+0; thence South 6 degrees 21 minutes 05 seconds West 107.7 feet to a point 160 feet opposite center line Sta. 7+0; thence South 13 degrees 48 minutes 49 seconds East 350.14 feet to a point 150 feet opposite center line Station 10+50 feet; thence South 5 degrees 59 minutes 15 seconds East 53.28 feet; thence South 59 degrees 11 minutes East 1940.05 feet parallel to and 100 feet North of the center line of an existing cover to the TRUE POINT OF BEGINNING. Section 2. The Legislature, pursuant to the application of LoBo Sand Co., Inc., (CU-97-020), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on May 15, 1997, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning...Attorney Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
