Body
WHEREAS, Hellix Construction, LLC, is engaged in the development of the Cedar Valley Subdivision, and has requested a permanent drainage easement across a portion of the Little Blue Trace Park to accommodate the release of stormwater into the Little Blue River from a detention pond in the subdivision, as more fully described in the attached Easement Agreement; and,
WHEREAS, in exchange for the requested easement, the developer will donate a tract to the County which will be utilized for an eventual extension of the Little Blue Trace Trail; and,
WHEREAS, the Acting Director of Parks and Recreation has determined that the permanent easement will have no adverse effect on park property and recognizes the public necessity of the provision of stormwater drainage; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Easement Agreement is hereby approved and that the County Executive is hereby authorized to execute the agreement on behalf of the County.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
