AN ORDINANCE creating Sewer District #102 to be known as Carriage Oaks Sewer District.

ORDINANCE# 1586, August 3, 1987

Body

 WHEREAS, pursuant to Section 249.430, RSMo. et seq., the County Legislature of Jackson County, Missouri, deems that a public necessity exists for the construction of sewers for sanitary purposes and for the creation of a County sewer district in an area known as the Carriage Oaks Subdivision which is generally located at the southeast corner of Missouri Highway 7 and Colbern Road, in Jackson County, Missouri; and,

 

WHEREAS, the Director of the Jackson County Department of Public Works recommends to the Legislature that such a sewer district be created; therefore,

 

BE                     IT                     ORDAINED                     by                     the                     County                     Legislature of                     Jackson County, Missouri, as follows:

 

1.                     The Legislature hereby finds that there exists a public necessity for the construction of sewers for sanitary purposes and for the creation of such a sewer district, and that the lots, tracts, and parcels within the proposed sewer district would be conveniently served by said sanitary sewers.

2.                     The Legislature further finds that publication of notice of a public hearing relating to the establishment of the sewer district was published according to law in THE KANSAS CITY STAR newspaper on July 10, 1987, and notice thereof was also posted in the proposed district as required by law.

 

3.                     The Legislature further finds that a public hearing on the establishment of the district was held on July 27, 1987, and that a majority of land owners within the sewer district did not file a written protest with the Legislature prior to the hearing.

 

4.                     The Legislature hereby creates Sewer District #102 to be known as the Carriage Oaks Sewer District and to be comprised of the following tract of land in Jackson County, Missouri:

 

DESCRIPTION:

Carriage Oaks Subdivision, Lots 1 through 17, and Tracts A and B, all lying within the south 1/2 of Section 30, Township 48 North, Range 30 West, Jackson County, Missouri.

Enacted and Approved

Effective Date:                     This                     ordinance shall                     be effective                     immediately upon its signature by the County Executive.
